Terms and Conditions of Sale

These Terms and Conditions apply to all purchases made from Dakar Aircon (“Dakar”, “we”, “us”, “our”) through our website.

These terms do not affect your statutory rights under UK consumer law.

1. Pricing and VAT

  • All prices are displayed in pounds sterling (£) and include VAT at 20%, unless stated otherwise.

  • We take reasonable care to ensure pricing accuracy.

  • In the event of a pricing error or supplier price increase, we will:

    • Contact you to confirm whether you wish to proceed at the corrected price, or

    • Cancel the order and issue a full refund

2. Contract Formation

  • Placing an order constitutes an offer to purchase.

  • A legally binding contract is formed only when we dispatch the goods and send a dispatch confirmation email.

  • Items not dispatched do not form part of the contract.

3. Delivery

Delivery is governed by our Shipping & Delivery Policy, which forms part of these Terms.

Key points:

  • Delivery is kerbside (curbside) only

  • The customer must ensure access and suitable personnel to receive the goods

  • Some products are delivered on pallets due to size or weight

Signing for delivery does not remove your statutory rights.

4. Damaged, Faulty, or Incorrect Goods

Your rights are protected under the Consumer Rights Act 2015.

If goods arrive damaged, faulty, or not as described:

  • Notify us as soon as reasonably possible

  • Photographic evidence may be requested

  • We will offer a repair, replacement, or refund, as required by law

  • No delivery or collection charges will apply for faulty goods

There is no fixed time limit that removes your right to report damage.

5. Returns and Refunds

Returns and refunds are governed by our Refund, Returns and Warranty Policy, which forms part of these Terms.

Key principles:

  • 14-day cancellation right for online purchases

  • No automatic restocking fees

  • Deductions only apply for loss of value caused by handling beyond inspection

  • Faulty goods receive a full refund, including standard delivery costs

6. Manufacturer’s Warranty

Any manufacturer’s warranty is provided in addition to, and does not replace, your statutory rights under UK law.

7. F-Gas Regulated Products

Certain air conditioning and refrigeration products are subject to F-Gas Regulations.

  • These products must be installed by a certified F-Gas engineer

  • If installation is not purchased from Dakar, we may request:

    • Written confirmation of the appointed engineer

    • F-Gas certification number

    • Proof of installation arrangement

We may delay dispatch until compliance is confirmed, as required by law.

8. Use of Website

We may suspend or refuse service if:

  • There is a breach of these Terms

  • There is suspected unlawful or fraudulent activity

This does not affect your statutory consumer rights.

9. Intellectual Property

All content on this website is owned by or licensed to Dakar Aircon and is protected by applicable intellectual property laws.

You may not copy, reproduce, or distribute content without written permission.

10. Accuracy of Information

Product descriptions, images, and availability are provided for guidance.

  • Images may differ from actual products

  • Availability is subject to stock levels

Nothing in this section limits your legal rights.

11. Privacy and Cookies

Your personal data is processed in accordance with our Privacy Policy and Cookie Policy, which comply with UK GDPR and the Data Protection Act 2018.

12. Third-Party Links

We are not responsible for third-party websites linked from our Services.

13. Governing Law

These Terms are governed by English law, and the courts of England and Wales have exclusive jurisdiction.
